GENERAL
The general terms and conditions of the JT Labs online store (hereinafter referred to as “general terms”) are prepared in accordance with the current Consumer Protection Act, the Personal Data Protection Act, and other relevant legislation.
The JT Labs online store is operated by JT Labs, proizvodnja, trgovina in storitve, d.o.o., with the production address at Za Ljubnico 2, 3333 Ljubno ob Savinji, Slovenia, registration number: 9441921000, tax number: SI 92015603, email: info@jt-labs.eu (hereinafter referred to as “the provider”).
The provider requests that the customer carefully reads the general terms of the online store, as they become binding at the moment the customer enters the JT Labs online store. It is considered that the customer, upon entering the JT Labs online store, is aware of and agrees to the entire content of the general terms without limitations.
DEFINITION OF TERMS IN THE ONLINE STORE
The following terms are used in the online store:
- Customer: A natural or legal person who is in a legal business relationship with the provider, regardless of their legal or status form.
- Consumer: Any customer who is a natural person and acquires or uses goods or services from the provider for personal purposes or purposes outside their professional or business activity.
- Goods: All products offered in the online store.
- Contract: A written agreement concluded between the provider and the customer. A contract is also considered to be an offer, pro forma invoice, or invoice sent by the provider to the customer, which the customer accepts or confirms. The general terms are an integral part of every contract.
APPLICATION OF GENERAL TERMS AND CONDITIONS
The general terms form an integral part of the contracts concluded between the provider and the customer concerning the purchase of goods via the JT Labs online store.
The provisions of the general terms also apply to all offers, pro forma invoices, preliminary contracts, legal business statements, and other services arising from the business relationship between the provider and the customer.
Submitting a valid order in the JT Labs online store is considered the signing of a contract.
The provider reserves the right to make any changes to the general terms at its discretion without special notice. The changes become effective from the moment they are published and are binding for the customer.
PRIVACY AND DATA PROTECTION
The provider is committed to carefully protecting the customer’s privacy. All personal data of the customer is confidential and will not be disclosed to unauthorized persons under any circumstances. Detailed information on how the provider collects, stores, and processes the customer’s personal data, as well as all customer rights regarding personal data processing, is available under the “Privacy Policy” section.
The provider processes the customer’s personal data on the website using cookies to collect information about the customer’s online store activity. More information on cookies can be found under the “Cookies” section.
PRICES
All prices in the JT Labs online store are displayed in euros (€/EUR) and include value-added tax (VAT) but do not include delivery or shipping costs.
These are regular prices, and the provider reserves the right to change them without prior notice. Prices apply in cases where payment is made using the methods listed below. The prices and discounts that were valid at the time the provider’s information system received the customer’s order will apply.
All promotional prices and codes are clearly marked. The validity periods of promotional prices and codes are indicated in the online store. In the case of a price reduction, the provider indicates the previous price and the new reduced price. The previous price is considered the lowest price used by the provider in the last 30 days before applying the new reduced price. Discounts are applied only to the product price, not to shipping costs. Promotional codes and discounts cannot be combined. Only one promotional code can be used per order.
If, for any reason, a promotional price or code is not applied during checkout, the customer must notify the provider in advance to request a correction. If the customer pays the amount calculated without the promotional price or code, it is considered that the customer has implicitly accepted the final price and cannot subsequently raise objections to the provider.
Promotional prices or codes do not apply to legal entities.
PAYMENT METHODS
The provider offers the following payment methods for purchases from the online store:
- Payment by credit card (MasterCard, Visa, etc.)
- Payment via EPS, Bancontact, Ideal, Przelewy24 payment systems
- Payment by pro forma invoice (bank transfer to the provider’s account)
ORDERING PROCESS
Ordering can be done in both Slovenian and English.
The online store is open 24 hours a day, every day of the year.
Ordering process for legal entities is the same as for individuals, with the exception that when completing the purchase, the legal entity must also enter the company name and tax number. The fields for company details must contain the personal information of the legal entity’s authorized representative.
Submitting an order
The customer selects the desired product and adds it to the cart by clicking the “Add to Cart” button. Any number of products can be added to the cart. If the customer wishes to obtain more information about the selected product, they can click on the product image or name.
In the cart, the customer can view the list of selected products, change the quantity, recalculate the price based on the changed quantity, or remove an item from the cart.
Once the customer has finalized adding or modifying the products, they can continue shopping later, as the products in the cart will be saved for future purchases.
When the customer has all the products they wish to order in the cart, they click on the “Proceed to Checkout” button.
In the “Checkout” step, the customer enters all the required contact information and selects the payment and delivery method.
If the customer has a promotional code or coupon from the provider, they can enter it in the appropriate field during the checkout.
Before submitting the order, a summary of the order ready for submission is displayed, clearly showing the main features of the goods, the final price, and information on any additional shipping, delivery, or postage costs. The customer has the opportunity to verify the entered information or identify possible errors and correct or modify details related to the order (such as the quantity and type of products, customer details, delivery method and location, and payment method).
If the customer agrees with the entered information, they confirm the order by clicking the “Submit Order” button. By submitting the order, the customer agrees to fulfill the contract and confirms that they are obligated to pay and are aware of these general terms and conditions.
Once the order is successfully submitted, the system will display an order number.
After submitting the order, it is no longer possible to change the payment method. It is also no longer possible to add products to an existing order. Changes to the delivery address can be arranged directly through the delivery service.
Order processing and rejection
The JT Labs online store will begin activities necessary for the fulfillment of the accepted order immediately after receiving it.
An order that cannot be fulfilled under the conditions and data available to the online store will be rejected. The customer cannot demand the fulfillment of such an order.
The provider reserves the right to cancel an order if the goods ordered are no longer available after the order has been placed. In such cases, the provider will immediately notify the customer and refund the amount paid for the goods using the same payment method that the customer used.
Order confirmation
The order becomes valid the moment the customer submits it.
After successfully submitting the order, the customer will receive an email confirming the receipt and approval of the order.
The provider may contact the customer via the provided email address to verify the data or ensure the accuracy of the delivery.
Contracts are concluded in Slovenian. The provider stores them in electronic form at the company’s headquarters. The customer can request a copy in PDF format by emailing info@jt-labs.eu.
Invoice
The invoice issued by the provider after the customer’s purchase serves as proof of the transaction.
Delivery of goods and shipping costs
Orders are prepared and dispatched as quickly as possible. The provider does not ship goods on Saturdays, Sundays, or holidays.
The customer has the option of personal pickup which is free of charge at the following locations:
- Za Ljubnico 2, 3333 Ljubno ob Savinji (production location)
- Ter 42, 3333 Ljubno ob Savinji (Reception of the Herbal Glamping Resort Ljubno)
- Lesarska cesta 10, 3331 Nazarje
Pickup time can be arranged by prior agreement via email at info@jt-labs.eu.
Delivery is made to the address specified by the customer during the order.
The delivery costs for shipments within Slovenia for consumers are:
- Free shipping for orders over 160 EUR
- For orders under 160 EUR, the exact shipping cost is specified before checkout in the total cost display.
Delivery costs for consumers for international shipments depend on the country of the delivery address and the order value. The exact shipping cost is specified before checkout in the total cost display.
- Free shipping for orders over 200 EUR
- For orders under 200 EUR, the exact shipping cost is specified before checkout in the total cost display.
The provider will hand over the package to the delivery service, along with the customer’s address, email address, and phone number. The delivery service will notify the customer via email or SMS about the expected delivery and any cash-on-delivery amount. The final delivery to the customer’s address depends on the conditions of the delivery service. On the day of delivery, the courier will send the customer a notification with the estimated delivery time.
If the provider is unable to dispatch the goods within the promised time frame due to logistical reasons (e.g., an increased number of orders, holiday periods, etc.), the customer will be promptly notified of the new delivery time via the provided contact details.
The provider does not assume any (compensatory or other) liability for delays in delivery time.
The provider is also not responsible for failure to deliver goods due to force majeure, in accordance with Article 153 of the Obligations Code (OZ, UL RS No. 97/07).
Withdrawal from the Contract
In accordance with Article 152 of the Consumer Protection Act (ZVPot-1), the consumer has the right to notify the provider within 14 days of receiving the goods that they are withdrawing from the contract, without needing to provide a reason for such a decision.
The withdrawal period begins the day after the goods are received. If the delivery of ordered products is carried out in multiple shipments due to logistical or other reasons, the period begins the day after the final shipment is received.
The consumer must notify the provider of their withdrawal from the contract via email at: info@jt-labs.eu.
In the event of contract withdrawal, the consumer must return the received goods at their own expense by post to the provider’s address: JT labs, proizvodnja, trgovina in storitve, d.o.o., Za Ljubnico 2, 3333 Ljubno ob Savinji, Slovenia.
The consumer must return the goods to the provider undamaged and in their original quantity (unused), in the original, unopened, undamaged, and unmarked packaging. The goods must be returned together with a copy of the invoice and the consumer’s personal details.
The consumer has no right to withdraw from the contract for products that were made according to the consumer’s specific instructions or customized to meet their personal needs, which by their nature are not suitable for return, are perishable, or whose expiration date has already passed.
The provider will refund the amount paid by the consumer as soon as possible, but no later than 30 days from the receipt of the notice of withdrawal and the return of the goods.
The provider will refund the consumer using the same payment method the consumer used unless the consumer expressly requests the use of a different payment method and the provider incurs no additional costs in doing so.
In the case of a contract withdrawal where a promotional code was used, these funds are treated as a discount and will not be refunded to the consumer. Only the amount actually paid will be refunded.
Products sold as a set are considered a single item. This means that withdrawal from the contract for products sold in a set is only possible for the entire set and not for individual products within the set.
Warranty for Goods Compliance
The provider undertakes to deliver goods that meet the subjective and objective requirements for the goods’ compliance, as stipulated by the Consumer Protection Act (ZVPot-1).
The provider is not liable for non-compliance with the goods that appears after two years from the date the goods were delivered.
For hygiene and safety reasons, the provider will not accept goods (and thus will not offer exchanges or refunds) that have already been used. The provider recommends that the customer carefully reviews the ingredients and descriptions of products before purchasing. In case of any uncertainties, questions, or requests for more detailed information about the products, the provider can be contacted via email at: info@jt-labs.eu.
The consumer has the right to assert warranty claims in case of non-compliance with the goods (if the goods do not possess the features explicitly guaranteed by the provider, if the wrong goods or quantity were delivered, or if the goods otherwise deviate from the customer’s order), in accordance with Article 81 of the Consumer Protection Act (ZVPot-1).
The consumer must notify the provider of any non-compliance with the goods within two months of discovering the non-compliance, via the provider’s email: info@jt-labs.eu. The notification must include the following information:
- Name and surname
- Order number
- Detailed description of the non-compliance (e.g., damage, wrong product, wrong quantity)
- Attachment 1: Photograph of the package showing the label with the customer’s information
- Attachment 2: Photograph of the contents of the package showing the non-compliance
- Attachment 3: Copy of the invoice
The consumer must allow the provider to inspect the goods claimed to be non-compliant.
In the event of non-compliance with the goods, the consumer is entitled to:
- First, request that the provider restore the goods to compliance (repair or replace the goods with new, faultless ones) free of charge,
- Only if this is not possible, or if it would incur disproportionate costs for the provider compared to other warranty claims, the consumer may request a proportionate reduction in the purchase price or withdraw from the sales contract and request a refund of the entire paid amount.
The consumer can request a reduction in the purchase price proportionate to the non-compliance or withdraw from the contract in any of the following cases:
- The provider has not repaired or replaced the goods, or has not completed the repair or replacement in accordance with the law, or has refused the consumer’s warranty claim for restoring the goods to compliance because the repair and replacement are not possible or would incur disproportionate costs,
- The non-compliance persists despite the provider’s attempt to restore compliance,
- The nature of the non-compliance is so serious that it justifies an immediate proportionate reduction in the purchase price or withdrawal from the contract, or
- The provider has stated or it is evident from the circumstances that the provider will not restore compliance within a reasonable period or without inconvenience to the consumer.
If the non-compliance appears within less than 30 days from the delivery of the goods, the consumer may withdraw from the contract and request a refund of the paid amount.
If the existence of non-compliance is disputed, the provider will notify the customer within 8 days of receiving the warranty claim.
The provider will refund the purchase price to the consumer immediately, but no later than 8 days after receiving the goods.
If the consumer requests a proportionate reduction in the purchase price and it is justified, the provider will refund the proportionate part of the purchase price within 8 days of receiving the request for a proportionate reduction.
The provider emphasizes that increased sensitivity or an allergic reaction to the delivered goods is not considered non-compliance. The provider is not liable for non-compliance if the consumer was specifically informed that a particular feature of the goods deviates from the objective requirements for compliance and the consumer expressly and separately accepted this deviation (e.g., damaged packaging).
The consumer cannot withdraw from the sales contract if the non-compliance is minor.
Complaints
All products are inspected before delivery to the customer and are carefully packed in a box for delivery in their original, undamaged packaging.
The risk of loss or damage to the dispatched goods passes to the customer once they physically take possession of the goods or when the goods are received by a third party designated by the customer (other than the courier).
If the goods received by the customer are damaged (e.g., a product has leaked, a dispenser is broken), or if the package is missing contents or the contents do not match what the customer ordered, the customer must initiate the complaint process with the provider. A legal entity must do so immediately, while a consumer must do so within the prescribed deadlines.
The customer initiates the complaint process by notifying the provider in writing via email at info@jt-labs.eu. The notification must include the following details:
- Name and surname/company name
- Order number
- Detailed description of the non-compliance (damage, wrong product, wrong quantity)
- Attachment 1: Photograph of the package showing the label with the customer’s information
- Attachment 2: Photograph of the contents of the package showing the non-compliance
- Attachment 3: Copy of the invoice
If the customer requests a replacement for the goods because the wrong goods were delivered, the customer must return the goods to the provider unused, in unchanged quantity, undamaged, unopened, and in the original packaging. The provider will cover the return shipping costs.
The customer must inspect the received goods immediately. In the event of damage to the product during transport, the customer may refuse the goods upon delivery (i.e., not accept the product). In such a case, the customer fills out a damage report with the courier, which serves as the basis for resolving the complaint. On this basis, the provider will replace the damaged product with a new one.
SECURITY
Shopping and payments through the online store are secure. All transactions made in the online store are protected by the Transport Layer Security (TLS) protocol.
All card payments are processed in real-time with immediate verification of data by the banks for your security. You can make a payment using a credit card (MasterCard, Visa, Visa Electron, Diners Club, American Express).
All data you provide to us is encrypted using TLS data encryption technology. This advanced encryption process ensures that personal data cannot be intercepted as it travels from the customer’s computer to the provider’s computer or from the provider’s computer to the bank. Personal data is transmitted in encrypted form from the customer’s computer to the bank’s authorization server and is not stored on the provider’s server.
INTELLECTUAL PROPERTY
All rights are reserved. All texts, images, graphics, sound files, animations, videos, and their derivatives on this site are subject to copyright protection and other intellectual property rights. These items may not be copied for commercial use or distribution, nor may they be modified or republished on other websites. This online store may also contain images for which the provider has obtained the right to use but are protected by third-party copyrights.
The provider is not responsible under any circumstances for any links that are not part of this online store or for any other websites that are or are not linked to this online store. The provider disclaims all responsibility for the accuracy of any information available on these linked pages or any products or services available on those sites.
LIMITATION OF LIABILITY
The provider assumes no responsibility for any consequences of using the online store and its content.
The goods in the online store are intended solely for external, cosmetic use. It is the customer’s responsibility to use the goods safely and in accordance with their intended purpose. The provider is not responsible for any damage that may result from improper use of the goods or lack of knowledge by the customer.
The provider strives to present the most accurate, correct, and up-to-date information in the online store. However, unintended errors regarding prices, delivery times, product descriptions, etc. are possible, and for these, the provider assumes no liability for damages or any other claims.
The provider respects honest business practices and expects the customer to review the final invoice before payment. In case of any discrepancies, the customer is expected to notify the provider in advance. The customer assumes responsibility for the legal transaction that arises upon payment of the purchase price, thus tacitly acknowledging the correctness of the final invoice and ordered goods.
All product photos in the JT Labs online store are symbolic.
All information on the JT Labs website is for informational purposes only and cannot be considered a substitute for a consultation with a doctor or pharmacist.
The online store is open every day, 24 hours a day. Due to various technical reasons, transactions through the online store or even access to the store may not always be possible. Therefore, the provider reserves the right to limit or completely halt the sale of certain or all products for a fixed or indefinite period or to limit or completely halt access to the online store. The provider assumes no responsibility for the malfunction of the store due to misuse, any consequences of the misuse of the online store, or the failure of the service due to network outages, power outages, or other technical disruptions that could temporarily, or for a longer time, interfere with usage.
REVIEWS AND COMMENTS
By submitting a review or comment, the customer expressly agrees to the terms of use of their review or comment and grants the provider the right to publish part or all of the text in any electronic or other public communication media. The provider has the right to use the content of the review or comment indefinitely and for any purpose that is in the business interest of the provider, including in advertisements or other marketing communications.
The provider commits to taking reasonable steps to verify that the reviews and comments about products have been submitted by customers who have actually purchased or used the product.
COMPLAINTS AND DISPUTES
The interpretation of the general terms and all disputes between the provider and the customer shall be governed and subject to the laws of the Republic of Slovenia.
The provider and the customer agree to resolve any disputes amicably. If an amicable solution cannot be reached, the locally competent court in the Republic of Slovenia will have jurisdiction over resolving disputes.
Complaints, comments, claims, and statements can be sent by users via email to info@jt-labs.eu or by post to the address: JT Labs, Za Ljubnico 2, 3333 Ljubno ob Savinji, Slovenia.
The complaint handling process is confidential. The provider will confirm receipt of the complaint within 5 business days, inform the customer how long the complaint will be processed, and keep the customer informed throughout the process.
The provider and the customer, as participants in electronic commerce, mutually acknowledge the validity of electronic communications in court.
The provider does not recognize any provider of out-of-court consumer dispute resolution as competent for resolving consumer disputes that the consumer could initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act.
The provider operates the online store in the territory of the Republic of Slovenia and publishes an electronic link to the platform for online consumer dispute resolution, which is available here.
FINAL PROVISIONS
If any provision of the general terms of business is wholly or partly unenforceable or invalid (void, unlawful), it shall be deemed not to be part of the general terms and conditions and shall not affect the validity or enforceability of the rest of the general terms. The invalid or unenforceable provision shall be replaced by a provision that most closely matches the intent of the invalid or unenforceable provision.
